Two different set of lawyers dropped this case because the Georgia Bureau of Investigation claims the victim had a gun and fired at officers. We took over the case. The lower court dismissed the case at summary judgment, but we appealed—and won. The Eleventh Circuit Court of Appeals ordered a trial on the excessive force claim, despite a gun being found. Unfortunately, prior to trial, the U.S. Supreme Court passed a law essentially saying that Federal Officer could not be sued under an action nicknamed “Bivens.” After that and because our case was against federal officers, the case was dismissed based on the law.
